Terms of Service

Diagnostics and Repairs: Screen Surgeons will attempt to diagnose your laptop computer LCD screen , provide an estimate of applicable service fees (plus parts if required), and then provide you with a repair and replacement solution. In certain cases, however, LCD display repair and/or replacement may not be completed because of a problem with your computer or its configuration that is beyond our control.

(b) Your Responsibility: While Screen Surgeons will make all reasonable efforts to safeguard the contents (data) stored on your computer, you understand and agree that prior to contacting or allowing Screen Surgeons to perform diagnostic, repair, replacement or other services on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives if you so desire. You acknowledge and agree that Screen Surgeons and/or its third-party service provider shall not be responsible under any circumstances for any loss, alteration, or corruption of any software, data, or files.

(c) Service Fees: If Screen Surgeons is successful in providing a repair and replacement solution for your laptop LCD monitor, you understand the the service feeis what was quoted in the email quotation unless modified by further email/phone communication. If Screen Surgeons is unable to reach you via telephone or email within 30 days of the service completion date we will notify you via U.S. certified mail. Screen Surgeons accepts no responsibility for any unclaimed goods left in our facility for which service fees are due and have not been paid within 30 days after Screen Surgeons obtains a receipt indicating delivery or attempted delivery of the certified letter was made. I agree that Screen Surgeons may dispose of any unclaimed goods and hereby release Screen Surgeons and waive any claims regarding such disposal.

(d) Repair Turnaround Times: The turnaround times published on the Screen Surgeons web site or in email communication do not include shipping time in transit and reflect only actual time in shop. Turnaround time also depends on availability of parts. If required parts are not in stock the turnaround time will not start until parts become available.

(e) Your Responsibility Regarding Shipping: (1) Initial laptop shipment from you to Screen Surgeons: It is very important that you properly package your laptop prior to shipment to us. If you are using a laptop shipping container provided by Screen Surgeons you agree to follow the packaging instructions provided with the box. You further agree that damages that occur during shipping will be sole responsibility of the shipping carrier and that Screen Surgeons is not responsible for such damages. (2) Final shipment from Screen Surgeons to you: Upon receipt of returned items from Screen Surgeons you are responsible for inspecting and noting obvious damages to the package exterior to the delivery person at the time you accept the package. You must accept the package before you can make a damage claim. Where shipped items have received damages internally, you are responsible for reporting this damage to Screen Surgeons with 24-48 hours after receiving the package at which time we will advise you on damage claim procedures. IMPORTANT: You must keep all packaging materials and have them ready for pickup and inspection by a shipper representative. DO NOT RETURN DAMAGED MERCHANDISE to Screen Surgeons, the shipper must first validate the damage claim.

SERVICE LIMITATIONS; LIABILITY

(a) LIMITATIONS TO SERVICE: Screen Surgeons RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED SERVICES AND INSTEAD REFUND YOUR PAYMENT, WHOLLY OR IN PART, ON THE BASIS THAT YOUR TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY Screen Surgeons.

(b) FORCE MAJEURE: If Screen Surgeons’s ability to render laptop display repair and replacement services is impaired by you or circumstances beyond the control of Screen Surgeons, Screen Surgeons may choose not to provide or to discontinue services.

(c) LIMITATION OF LIABILITY: To the extent permitted by law, you agree that Screen Surgeons’s total liability for damages related to its services is limited to the total amount you pay for the these services (plus parts if applicable), and you release Screen Surgeons from liability for any indirect, incidental, special, or consequential damages. Screen Surgeons IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO USE YOUR COMPUTER EQUIPMENT OR OTHER PRODUCT.

(d) LIMITATION OF LIABILITY DURING SHIPPING: Screen Surgeons uses USPS, Fed Ex and UPS as reliable shipping carriers and in some cases provides up to $1000 in shipping insurance for each shipment. Screen Surgeons is not responsible for damages that occur during shipping, however damages should be processed using the procedures set forth by the carrier. Screen Surgeons will provide damage claim assistance provided you follow the damage claim procedures outlined in the terms of service section (e) above.
